President of the Personal Data Protection Office at the conference on Digital Services Act

A speech given by Miroslaw Wróblewski, the President of the Personal Data Protection Office, opened the conference on 'The Digital Services Act through the eyes of commentators'.

The conference was organised by the Centre for Personal Data Protection and Information Management, the Regional Chamber of Legal Advisors in Łódź and the Department of European Economic Law.

During the meeting, scientific editors and authors of comments on the EU Digital Services Act, as well as representatives of online platforms and search engines and NGOs analysed the provisions of the regulation, pointed out practical aspects of its implementation and discussed interpretation problems encountered.

In his presentation, Miroslaw Wróblewski, the President of the Personal Data Protection Office, included among the most relevant issues related to the application of the Digital Services Act (DSA) the following:

  • changing approach from liability (responsibility linked strictly to legal obligations) to responsibility (legal and social responsibility of providers of intermediary services, also directed towards the effective implementation and promotion of the protection of fundamental rights set out in the EU Charter of Fundamental Rights, including in particular the protection of consumers and their personal data), in order to facilitate the achievement of the DSA's objectives;
  • the nature of the DSA's relationship to the GDPR, which are " complicated, understated and raise many doubts";
  • the risk of inconsistencies between the existing personal data acts and the new regulations of the Digital Package;
  • the important role of data protection authorities in implementing the EU Digital Package acts.

The President of the Personal Data Protection Office also highlighted the practical importance of three DSA provisions covering: dark patterns (Article 25 DSA), advertising on online platforms (Article 26 DSA) and the online protection of minors (Article 28 DSA).

The conference took place on 15 March 2024 at 9:45 a.m. in the Violet Auditorium in the Faculty of Law and Administration of the University of Lodz, 8/12 Kopcińskiego Street. The Personal Data Protection Office, in addition to Mirosław Wróblewski, the President of the Personal Data Protection Office, was represented by Agnieszka Grzelak, the Deputy President of the Personal Data Protection Office, and Piotr Drobek, counsellor of the Personal Data Protection Office.
